JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-03-2018 This criminal miscellaneous has been filed for modification in the order dated 12.12.2017 passed in Cr. Misc. No. 47282 of 2017 for extension of time to surrender. Heard the learned counsel for the petitioner and learned A.P.P. for the State.

It is submitted that the petitioner Meharban Khan @ Punwa was living in Pune along with his family to earn his livelihood and after granting bail he became seriously ill and could not come to Bhagalpur within time and as soon as he recovered good health he immediately proceeded on 09.02.2018 for Bhagalpur from Train No. 12149 Pune Danapur Express

Patna High Court Cr.Misc. No.12739 of 2018(2) dt.07-03-2018 2/2 and he reached at Bhagalpur on 11.02.2018 but the stipulated time has been expired on 17.01.2018 itself resulting, he could not furnish his bail bond.

Considering the ground reasonable and sufficient, this criminal miscellaneous for modification is allowed and the petitioner Meharban Khan @ Punwa is directed to surrender within four weeks form the date of receipt/production of a copy of this order in the court of learned S.D.J.M., Bhagalpur in connection with Shakund P.S. Case No. 113 of 2017 and then he shall be released on bail as per terms and conditions of order dated 12.12.2017.
