====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioners and the State.
Petitioners are apprehending their arrest in connection with a case registered for the offences under Section 307 and other allied Sections of the Penal Code. There is a counter-case as well but later good sense prevailed between the parties, so submitted learned counsel for the petitioner and they have entered into a comprise. Compromise petition is Annexure-2, perusal whereof, however, refers to only the number of the present case and not the counter-case.
In the circumstances, I deem it expedient to direct
Patna High Court Cr.Misc. No.41380 of 2015 (2) dt.13-10-2015 2/2 the petitioners herein as also the informant of the case to appear before the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below. If it is accepted by the parties that the matter has been settled outside the court, the petitioners, named above, be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Kako (Jehanabad) P.S. Case No. 57/15, subject to the conditions laid down under Section 438(2) Cr.P.C. In case, it appears to the court below that the matter has not been settled outside the court, the court below shall pass appropriate order in accordance with law. For a period of four weeks no coercive steps be taken against the petitioners.
The petition is, accordingly, disposed of.
