Petitioner apprehends his arrest in connection with Piro P.S.Case No. 96 of 2015 registered for the offences punishable under Sections 307/34 of the Indian Penal Code. Allegation against the petitioner is that he fired but does not hit anybody and allegation against other accused persons is of assault.
Submission of learned counsel for the petitioner is that as petitioner is eye-witness to murder of his father in which informant is an accused, the petitioner has been falsely implicated in this case just to pressurize him and FIR shows that nobody was hit by the shot fired by the petitioner.
Heard learned APP, who has opposed the prayer for
Patna High Court Cr.Misc. No.13422 of 2018 (2) dt.06-04-2018 2/2 anticipatory bail of the petitioner stating that petitioner has criminal antecedents.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender and pray for regular bail, which shall be considered by the court below on the basis of materials on record as well as the aforesaid submission, without being prejudiced by this order. With the above observation, this application is disposed of.
