Petitioner apprehends his arrest in connection with Jamalpur Rail P.S.Case No. 18 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires in the confessional statement of co-accused and paragraph-3 of the petition shows that he is accused in two other cases also.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and further though he was accused in two other cases but in both the cases final form has been submitted by police and at present no other case is pending against him.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, surrender within a period of four weeks and on his so surrendering he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway Kiul (Lakhisarai), in connection with Jamalpur Rail P.S.Case No. 18 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
