1. The present petition has been filed for restoring a petition bearing MJC No.1637 of 2019, which has stood dismissed for default on account of non-compliance of the peremptory order dated 15.05.2019.

2. The learned counsel for the petitioner submits that on account of miscommunication, the defects could not be removed within the time specified for removal of the defects, pointed out by the Registry, however, the same have already stood removed, hence a sympathetic view be taken and the aforesaid petition be restored to its original file.

3. Having regard to the submission made by the

Patna High Court MJC No.2989 of 2019(3) dt.05-03-2025 2/2 learned counsel for the petitioner as also considering the averments made in the present petition, this Court deems it fit and proper to restore the aforesaid petition bearing MJC No.1637 of 2019 to its original file, however, subject to the Registry verifying as to whether the defects pointed out by the Registry have stood removed or not.

4. The petition stands disposed off on the aforesaid terms.
