The petitioner apprehends his arrest in connection with Raghopur P.S. Case No. 37 of 2016 registered under Sections 272, 273, 308 of the Indian Penal Code and 47(A) of the Excise Act.
The accusation is that on search of hut of the petitioner, 200 pouches, each containing 200 ml., country made liquor recovered, while the petitioner and two other ladies succeeded to flee away.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. itself that the said country made liquor is not recovered from the house of
Patna High Court Cr.Misc. No.34080 of 2016 (2) dt.26-08-2016 2/2 the petitioner, rather it is recovered from the open hut, which is said to be of the petitioner. It is also submitted that petitioner was not apprehended by the Police on spot. Mere on suspicion, her name has been figured in the present case. Further submission is that petitioner is a lady and has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-IV, Hajipur at Vaishali in connection with Raghopur P.S. Case No. 37 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
