The petitioner has filed the instant application for grant of regular bail in connection with Khanpur P.S. Case no. 90 of 2020 registered under sections 304B and 34 of the Indian Penal Code.

As per allegation in the FIR, the grand daughter of the informant was married to the son of the petitioner. It is stated that soon after the marriage, the informant's grand daughter was tortured for non-fulfillment of the demand of dowry and ultimately poisoned to death.

It is submitted by learned counsel for the petitioner that that a supplementary affidavit has been filled bringing on

Patna High Court CR. MISC. No.10039 of 2021(3) dt.23-07-2021 2/2 record the fact that the son of the petitioner herein who was the husband of the deceased died on 6.1.2021. On merits it is submitted that the petitioner is the father-in-law of the deceased. The allegation besides being general and omnibus are false and concocted. The petitioner is in custody since 21.8.2020 and has no criminal antecedent.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody for 11 months together with investigation in the case having concluded, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Khanpur P.S. Case no. 90 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge V, Samastipur.
