The petitioner has preferred this application for grant of regular bail in a case registered under section 30 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 15 litres of country liquor was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the petitioner's possession or his house. He has been falsely implicated in the case. The fact that no incriminating article has been recovered would be evident from the contents of the seizure list wherein the place of recovery is only said to be village Parari, Ward no. 01. The petitioner is in custody since 19.6.2021 and charge sheet has been submitted in the case. It is

Having heard learned counsel for the parties and taking into consideration the facts of the case, the submissions made on behalf of the petitioner, the petitioner having remained in custody for about 10 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Alauli P.S. Case no. 215 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Khagaria.
