02. 26.10.2016 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 413 and 414 of the Indian Penal Code, Section 4(A) of Bihar Cattle Act, 1955 and Section H(1) A, B, C and D of Bihar Cattle Trespassers Act.
As per the allegation, one tonne of cattle meat was found in the vehicle, the apprehended driver of which has stated that his owner, Sahnawaz Hussain has sent him to bring the cattle meat from the house of the petitioners which was being done by the driver.
Patna High Court Cr.Misc. No.43442 of 2016 (2) dt.26-10-2016 It is contended on behalf of the petitioners that in view the aforesaid submission of the driver that the petitioners were the owner of the cattle meat the petitioners have been implicated though nothing has been recovered from the possession of the petitioners Having regard to the facts and circumstances of the case, let the petitioners, namely, Mintu @ Md. Mintu and Akhlakh Ahmad @ Md. Akhlakh Ahmad @ Md. Eklakh Ahmad @ Md. Eklakh be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in connection with Baniyapur P.S. Case No. 196/2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri R.K. Yadav, Judicial Magistrate, 1st Class, Saran at Chapra or his successor subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
