JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bounsi P. S. case no. 59/2017 registered under sections 366A, 504 and 506/34 of the IPC.

Petitioner and two others are said to have abducted the victim but subsequently, victim was recovered and her statement under section 164 Cr.P.C was recorded. The victim, specifically, stated that she voluntarily had gone along with co-accused Chhotu Mandal and solemnized her marriage with him. The above stated co-accused Chhotu Mandal has already been admitted to anticipatory bail vide order dated 14.7.2017 passed in Cr. Misc. no. 32627/2017.

Patna High Court Cr.Misc. No.14232 of 2018 (2) dt.06-04-2018 Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Bounsi P. S. case no. 59/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
