JUSTICE SUDHIR SINGH ORAL ORDER 17-10-2019 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner seeks bail in a case for the offence registered under Section 37 (c) of the Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a and 26 of the Arms Act. The prosecution story, in brief, is that the petitioner in drunken state having loaded pistol created nuisance at the place of occurrence. The police came and arrested the petitioner with one country made loaded pistol.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 06.06.2019. Charge sheet/prosecution report has been submitted in the present case. The petitioner has got no criminal

There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner was arrested in drunken state with one loaded country made pistol. There is no compliance of Section 100 of Cr. P.C.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise, Samastipur, in connection with Singhia P.S. Case No. 73 of 2019, corresponding to G.R. No. 667 of 2019.
