The petitioner apprehends his arrest in connection with Barauni (FCI) P.S. Case No. 248 of 2016 registered under Section 47(A) of the Excise Act.
Submission is that it would appear from the F.I.R. that the name of the petitioner has been surfaced in the confessional statement of co-accused Banti Kumar and Rajesh Kumar, who were apprehended with 10 bottles of Country-made Foreign Liquor. Further submission is that nothing has been recovered from the possession of the petitioner and petitioner has no criminal antecedent.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.43807 of 2016 (2) dt.19-10-2016 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Begusarai in connection with Barauni (F.C.I.) P.S. Case No. 248 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
