JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 30-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.
It is a case of theft of a motorcycle in question. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that on the basis of confessional statement of coaccused, namely, Chhotu Kumar, the name of the petitioner came into light. He further submits that, as alleged, stolen article recovered from the house of the petitioner and in this respect, a separate case bearing Bachhwara P.S. Case No. 03 of 2021 was registered against the petitioner, in which, the petitioner is on
Patna High Court CR. MISC. No.63668 of 2021(3) dt.30-08-2022 2/2 bail. He further submits that there is no material against the petitioner in this case, except confessional statement of coaccused. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Bachhwara P.S. Case No. 06 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
