JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 06.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Kotwali P. S. case no. 185/2012 registered under sections 406, 419 and 420 of the IPC.

The accusation against the petitioner is that she was working as manager of Bank Karamchari Swablambi Cooperative Society Limited and she, in conspiracy with collection agents, misappropriated money collected for the bank but submission on behalf of the petitioner is that the petitioner was appointed as computer operator in the aforesaid bank and she was not manager of the said bank. Moreover, Secretary of the aforesaid bank accepted the

Patna High Court Cr.Misc. No.14301 of 2018 (2) dt.06-04-2018 responsibility and agreed to disburse the amount to the customers of the bank. It is further submitted that coaccused Rupak Kumar @ Rupak Sinha and Ajay Kumar @ Ajay Kumar Jha against whom there is allegation of collection of money, have already been admitted to anticipatory bail by this court.

It would appear from perusal of the record that the present case was lodged in the year 2012 and even after lapse of near about 7 years, investigation against the petitioner is still pending.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Kotwali P. S. case no. 185/2012 subject to condition as laid down under section 438(2) of the Cr.P.C.
