Learned counsel, appearing for petitioner points out that the petitioner was granted provisional bail by this court vide order dated 12-04-2016 passed in Cr. Misc. No. 15201 of 2016 for the period of three months subject to condition that within the above-said period, he may solemnize his marriage with the informant and, after solemnization of marriage, if a joint petition for confirmation of bail of the petitioner is filed, the trial court shall pass appropriate order on the petition of the parties. It is submitted that though the petitioner and the informant have already solemnized their marriage but they failed to file a joint petition before the trial court for confirmation of bail within the period, as prescribed by this court and., therefore, the
Patna High Court Cr.Misc. No.37430 of 2016 (2) dt.31-08-2016 2/2 period for filing of joint petition for confirmation of bail, should be extended.
The informant appeared in person and, accepted this fact that she has already solemnized her marriage with the petitioner.
In view of the aforesaid circumstances, the petitioner and the informant are directed to file a joint petition before the learned Ist Additional Sessions Judge/concerned court, Patna in connection with Special (POSCO) Case No. 140 of 2015 within one month from today and if, they do so, the concerned court shall pass appropriate orders in accordance with law. Accordingly, the order dated 12-04-2016 passed in Cr. Misc. No. 15201 of 2016 stands modified and, this modification petition stands disposed off.
