The petitioners pray for anticipatory bail in a case registered under Sections 406, 420, 467 468, 471, 120B, 387 and 323 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that a criminal case has been filed in a purely land dispute, for which the informant had already filed Title Suit No.910 of 2014 in the court of the Subordinate Judge, Motihari, which is pending and to put pressure upon the petitioner, the present case has also been filed. It is further submitted that petitioner No.2 is the descendant of khatiyani raiyat of the land and has made a gift of the same to
Patna High Court Cr.Misc. No.44534 of 2015 (2) dt.05-11-2015 petitioner No.1 and petitioner Nos. 3 and 4 are witnesses to the said gift deed. It is also submitted that the petitioners have no criminal antecedent.
On a consideration of the facts and circumstances of the case, it is directed that the petitioners (1) Chunnu Singh alias Chunnu Kumar Singh (2) Baban Singh alias Pawan Singh, (3) Rup Kishor Singh alias Brij Kishore Singh and (4) Krishna Singh, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Sub-divisional Judicial Magistrate, Sadar, Motihari in connection with Motihari Mufassil P.S. Case No.404 of 2014, subject to the other conditions as laid down under Section 438 (2) of the Cr.P.C.
