The petitioner apprehends his arrest in a case under Section 448, 323, 308, 379, 354(A)/34 of the Indian Penal Code. The informant alleged that she was going to open shop situated near her house but the petitioner and others came and stopped her from opening the shop and also assaulted her and torn her garments.

It is submitted that informant is sister-in-law (bhabhi) of the petitioner. There is series of litigation between the parties and a partition suit is also going and on account of some family dispute, making false and frivolous allegation, this case has been lodged.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.42493 of 2015 (3) dt.03-12-2015 2/2 allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Siddhartha Pandey, learned Judicial Magistrate, 1st class, Bhojpur at Ara in Imadpur P.S. Case No. 34 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
