Heard learned counsel for the petitioner and learned A.P.P. for the State.
Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner in the present case seeks regular bail in connection with Narpatganj P.S. Case No. 363 of 2020 registered for the offences under Sections 147, 148, 149, 341, 323, 325, 448, 302, 379 and 504 of the Indian Penal Code. As per prosecution case, the informant along with his family members were coming to their house then 18 accused persons named in F.I.R. including the petitioner brutally
Patna High Court CR. MISC. No.53759 of 2022(2) dt.23-12-2022 2/3 assaulted to informant and his family members with lathi, rod brick stones due to which they have sustained injuries and fell down. They also entered his house and looted the house hold items. It is further stated that father of informant died during treatment and other injured are getting treatment at hospital. Learned counsel for the petitioner submits that petitioner is innocent and committed no offence and has falsely been implicated in this case due to land dispute. There is general and omnibus allegation against the petitioner. It is submitted that the petitioner having no criminal antecedent and he is in custody since 12.07.2022. Charge sheet has already been submitted in this case. Further it submitted that similarly situated co-accused persons namely Santosh Kumar Risideo @ Santosh Risideo, Prameshwari Risideo @ Prameshwari Risideo and Gohal Risideo @ Gohul Risideo, have been granted bail by the coordinate Bench of this Court vide order dated 15.02.2022 in Criminal Miscellaneous No. 53758 of 2021.
Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two
