2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 504 and 506 of the Indian Penal Code and section 27 of the Arms Act.

3. As per allegation in the FIR, five accused persons including the petitioner are said to have surrounded the house of the informant and made indiscriminate firing.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in the case. General and omnibus allegation has been levelled against the petitioner. None is said to have been injured in course of firing. Similarly situated other accused person has already been enlarged on bail

Patna High Court CR. MISC. No.62307 of 2023(2) dt.22-09-2023 2/2 by another coordinate Bench of this Court vide order dated 24.2.2023 passed in Cr. Misc. No. 65306 of 2022. Petitioner is languishing in judicial custody since 28.7.2022.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM2nd, Madhepura in connection with Gwalpara PS Case no. 55 of 2021.
