2. The petitioner is apprehending his arrest in connection with Complaint Case No. 717 of 2023 for the offence under Sections 498 (A), 323, 307, 313, 34 of the Indian Penal Code.
3. As per the prosecution story, marriage of complainant - Amrita Kumari was solemnized with petitioner - Maruti Nandan Tiwari on 26.04.2021 according to Hindu custom. Further it was alleged that petitioner started demanding Rs. Five Lakhs in cash, Swift Desire Car as dowry from the
Patna High Court CR. MISC. No.56454 of 2024(4) dt.20-02-2025 2/3 informant. After refusal, complainant of this case was tortured by the petitioner after five months of marriage.
4. Learned counsel for the petitioner as well as informant submits that the case has been compromised amicably. Husband (petitioner) is ready to take his wife home and keep her with full honour and dignity. The learned counsel for the opposite party no. 2 also concedes this fact.
5. At the time of filing bail bond petitioner is directed to file an undertaking to that effect.
6. Learned APP opposes the prayer.
7. Keeping in view the facts and circumstances, let the petitioner be enlarged on bail.
8. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Kaimur at Bhabhua in connection with Complaint Case No. 717 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
