JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend arrest in a case registered for the offences punishable under sections 366(A), 504/34 of the Indian Penal Code.
It appears that the informant's minor daughter left her house and returned after quite a number of days. Learned counsel for the petitioners states that there is no material on record to establish that they forced the victim to go out. Further more, the victim girl in her statement under section 164 Cr.P.C. has not named the petitioners.
Patna High Court Cr.Misc. No.43864 of 2015 (2) dt.15-10-2015 Considering the aforesaid facts and circumstances of the case, the above named petitioners, in the event of arrest or surrender of the petitioners in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.5,000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha (Mahila) P.S. Case No. 19 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
