Petitioner apprehends his arrest in connection with Ghoghardiha P.S.Case No. 126 of 2015, G.R.No. 1916 of 2015, registered for the offences punishable under Sections 363, 366A, 120B and 506 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping of daughter of the informant.
Submission of learned counsel for the petitioner is that the statement of the victim recorded under Section 164 Cr.P.C. shows that though she has made allegation against the accused persons but she is residing with the petitioner happily along with her daughter.
Heard learned APP also.
Patna High Court Cr.Misc. No.14371 of 2018 (2) dt.11-04-2018 2/2 Having heard both sides and in view of the statement of victim girl, I am not inclined to grant anticipatory bail to the petitioner. However, this application is disposed of with a direction to the petitioner to surrender and make prayer for regular bail, upon which learned court below will summon the daughter of the informant and enquire about the fact as to whether she is living with the petitioner along with her daughter also and if the court below is satisfied with the same he will pass an appropriate order, without being prejudiced by this order.
