====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-02-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Sono P.S. Case No. 335 of 2017, registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The accusation is that 12 persons named in the FIR including the petitioner obtained appointment letters for Panchayat Teachers by submitting the fake mark-sheet. Learned counsel for the petitioner submits that without any inquiry and giving opportunity to the petitioner, the present case has been lodged. It is further submitted that similarly situated co-accused, Rani Kumari and Beauty
Patna High Court CR. MISC. No.54184 of 2019(4) dt.26-02-2020 2/2 Chaudhary, have already been granted privilege of pre-arrest bail by a Bench of this Court vide orders dated 08.10.2018 and 11.12.2018, respectively, passed in Criminal Misc. No. 48324 of 2018 and Criminal Misc. No. 57857 of 2018. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Jamui, in connection with Sono P.S. Case No. 335 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
