2.The accused/petitioner seeks bail in connection with Mahila P.S. Case No.31 of 2024 registered for the offences punishable under Sections 376, 509, 506, 354-C of the Indian Penal Code (in short 'IPC') as well as Sections 4 and 6 of the Protection of Children from Sexual Offences Act (in short 'POCSO Act') and Section 67 of the Information and Technology Act.
3. Considering the submissions and on

No.52634 of 2025(4) dt.27-11-2025 2/3 perusal of record, as victim could not examined by the learned trial court within preferred timeline of thirty days in view of Section 35(1) of the POCSO Act from the date of cognizance despite the fact that petitioner remains in custody since 04.04.2025, coupled with fact her statement as recorded u/s 183 of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS') Prima facie create a doubt qua penetrative sexual assault/rape, accordingly, the petitioner, above-named, is directed to be released on bail furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (POCSO Act), Darbhanga in connection with Mahila P.S. Case No.31 of 2024, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure (for short 'CrPC')/under Section 480(3) of the Bhartiya Nagrik Suraksha Sanhita (for short 'BNSS').
