JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Chakia P.S. Case No. 91 of 2016, disclosing offences under Sections 341, 323, 504, 379 and 308/34 of the Indian Penal Code.

No.38347 of 2016 (3) dt.22-09-2016 2/3 From the First Information Report, it appears that there is admitted enmity between the family of the petitioners and that of the informant. The daughter of brother-in-law of the informant appears to have lodged a case, under Section 498A of the Indian Penal Code, against petitioner Nos. 1, 2 and 3. It is alleged in the First Information Report that when the informant and others were coming back to their home from the Court after giving their evidence, these petitioners surrounded him and assaulted.
Considering the nature of allegation in the First Information Report and the background in which the First Information Report has been lodged, this application is allowed. Let the petitioner Nos. 1 to 4, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, East Champaran at Motihari, in connection with Chakia P.S. Case No. 91 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the

No.38347 of 2016 (3) dt.22-09-2016 3/3 petitioners, above named, shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
