JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 07-01-2022 Heard the parties through video conferencing. Learned counsel for the petitioners submits that during the pendency of the case, petitioner no. 2 namely, Badshah Singh has been arrested and as such he does not want to press this application for anticipatory bail against petitioner no. 2.

Accordingly, the prayer for anticipatory bail of petitioner no. 2, namely Badshah Singh having become infructuous, stands dismissed.

The petition is now restricted to petitioner nos. 1, 3 and 4 namely, Godhan Singh, Dilip Singh and Akash Singh @ Akash Kumar, respectively.

Patna High Court CR. MISC. No.9828 of 2021(3) dt.07-01-2022 2/2 The petitioner nos. 1, 3 and 4 seek bail in anticipation of their arrest in connection with Uchkagaon P.S. Case No. 275 of 2020 dated 17.08.2020 instituted for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

There are cross cases registered, where injuries have been caused on both the parties.

However, taking into consideration the nature of injuries, I am not inclined to grant anticipatory bail to petitioner nos. 3 and 4, namely Dilip Singh and Akash Singh @ Akash Kumar, while considering the age of petitioner no. 1, namely Godhan Singh is concerned, he is granted the benefit of bail in the event of arrest, he shall be released on anticipatory bail, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The application on behalf of petitioner nos. 3 and 4 namely, Dilip Singh and Akash Singh @ Akash Kumar, stands rejected.
