JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-06-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 169C of 2018, registered for the offences punishable under Sections 498A, 406 of the Indian Penal Code. It is a case of matrimonial dispute. As per allegation, the petitioner and his family members tortured Pratibha Kumari, wife of the petitioner, for non fulfillment of dowry demand. The matter was referred to Patna High Court Mediation

Patna High Court CR. MISC. No.12322 of 2021(4) dt.21-06-2022 2/2 and Conciliation Center. The mediation was successful. Both the parties have compromised the case and they are ready to lead their conjugal life in cordial atmosphere. It was agreed between the parties that petitioner shall deposit Rs. 20,000/- per month in the bank account of his wife Pratibha Kumari.

Considering that both the parties have settled their dispute amicably, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned sub-Divisional Judicial Magistrate, Saharsa in connection with Complaint Case No. 169C of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
