The petitioner apprehends his arrest in connection with Vigilance P.S. Case No. 106 of 2016, registered for the offences punishable under Sections 420, 109, 467, 468, 471, 472, 477A, 409, 120B of the Indian Penal Code and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act. Allegedly, the petitioner being Secretary of Managing Committee of Majharul Haque Degree College, Tarwara, Siwan delayed the payment of amount granted in the Session 2007-2010 which was deposited in the account of college on 26.12.2014 itself amounting to Rs. 1,23,900/- and payment was made between 04.03.2015 to 17.12.2016 and further payment was made to four teachers, whose post was not sanctioned and

Submission is of false implication and that the amount was paid to the teachers and non-teaching staffs with interest. So far as the four teachers are concerned, meager amount has been paid, each have been paid Rs. 4,000/- for total comes to Rs. 16,000/- and the petitioner is ready to deposit the said amount in the account of college.
The learned counsel for the Vigilance submits that in case the petitioner is ready to deposit Rs. 16,000/- in the account of the college then lenient view can be taken. In the facts and circumstances as stated above, in case the petitioner deposits Rs. 16,000/- in the account of the College then in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Vigilance P.S. Case No. 106 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. The petitioner will co-operate during investigation. (Jitendra Mohan Sharma, J.) Rajiv/- U T
