JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-09-2025 Heard learned counsel appearing on behalf of the petitioner, learned A.P.P. appearing on behalf of the State and learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.
3. As per prosecution case, informant suspects that all the F.I.R. named accused persons, including this petitioner, killed his son for the reason that the deceased was having dispute with them.
4. It is submitted by learned counsel for the petitioner
Patna High Court CR. MISC. No.51964 of 2025(2) dt.19-09-2025 2/3 that petitioner is quite innocent and has committed no offence. Informant is not an eye witness to the occurrence and in the F.I.R., only suspicion has been raised against all the F.I.R. named accused persons, including this petitioner, on the ground of previous dispute. There is no material on record to show the complicity of this petitioner in the alleged occurrence. Similarly situated co-accused person, namely Mahendra Paswan, has already been granted bail by a Co-ordinate Bench of this Hon'ble Court vide order dated 10.09.2025 passed in Cr. Misc. No. 60200 of 2025. Charge-sheet has already been submitted and petitioner is in custody since 30.09.2023.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, claim based on parity and period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Benipur,
