The petitioner apprehends her arrest in a case registered for the offence under Sections 363, 366, 34 of the Indian Penal Code.

It is alleged that this petitioner alongwith other F.I.R. named co-accused kidnapped the daughter of the informant. It is submitted on behalf of petitioner that petitioner has been made accused in this case merely on suspicion. Petitioner is co-villager of the informant and she has got no concerned with the alleged offence. Daughter of the informant is major and married lady and she went alongwith a boy with motorcycle and thereafter, she is alleged to have been kidnapped. The victim lady, in her statement recorded under Section 164 Cr.P.C., has not alleged any wrong against this petitioner. It is further submitted that two similarly situated co-

Patna High Court CR. MISC. No.53789 of 2022(3) dt.05-05-2023 2/2 accused persons have already been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 19.06.2020 passed in Cr.Misc. No. 3772 of 2020 (Annexure-2). Petitioner has got clean antecedent.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Basantpur P.S.
