Sri Kant Verma And ORS v. The State Of Bihar And ORS
IN THE HIGH COURT OF JUDICATURE AT PATNA
Miscellaneous Jurisdiction Case No.1833 of 2017 In Civil Writ Jurisdiction Case No. 15125 of 2010 ====================================================== Sri Kant Verma & Ors .... .... Petitioners
Versus
The State of Bihar & Ors .... .... Opp.Parties.
====================================================== Appearance :
For the Petitioner/s : Mr. Gopal Jha For the Respondent/s : Mr. AC to AAG-10 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 09-08-2017 Heard Sri Gopal Jha, learned counsel for the petitioners and learned AC to Addl. Advocate General no.10. The present restoration petition has been filed for restoring another restoration petition i.e. M.J.C.No. 1528 of 2017, which stood dismissed on 28.06.2017 due to nonprosecution. Learned counsel for the petitioners tried to persuade the Court about the reason for non-appearance. However, the fact disclosed in the petition is not sufficient to persuade the Court for allowing the petition. Accordingly, the present restoration petition for restoration of M.J.C No.1528 of 2017 stands dismissed.
It goes without saying that the main writ petition was not dismissed on merit. Accordingly, if so advised, petitioners
Patna High Court MJC No.1833 of 2017 (3) dt.09-08-2017 2/2 may avail appropriate remedy.
