The petitioner is apprehending his arrest in connection with Bhabua P.S.Case nO.271 of 2014 registered for offences punishable under Section 395 of the Indian Penal Code. Allegation against the petitioner as per FIR is of commission of dacoity in the house of the informant. It appears from the impugned order that later on a mobile was recovered from one co-accused Gopal Sah and he has named the petitioner as the person who has given mobile to him. It further appears from the impugned order that the petitioner was absconding and the process under Section 82 of the IPC was issued against him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.19428 of 2018 (2) dt.12-04-2018 2/2 circumstances, as stated above, this is not a case for grant of anticipatory bail.
With the aforesaid observation, this application is dismissed.
