Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Sanjhauli P.S. Case No. 84 of 2020/G.R. No. 1142/2020 for the offence registered under Sections 366(A)/34 of the I.P.C. The prosecution story, in brief, is that on 18.08.2020 at about 12.30 P.M., the daughter of the informant aged about 15 years, went to Sanjhauli Bazar for repairing her Mobile Phone

Patna High Court CR. MISC. No.10045 of 2021(2) dt.16-12-2021 2/3 but she did not return home till evening. After that her family members searched everywhere for her and after some days they got knowledge that the accused persons have kidnapped her daughter with a view to marry her.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The victim has been recovered and her statement under Section 164 Cr. P.C. has been recorded where she has stated that she had eloped with one co-accused Rahul Singh out of her own will and got married with him. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Sanjhauli P.S. Case No.
