The petitioner has preferred this application for grant of regular bail in a case registered under section 414 of the Indian Penal Code and sections 30(a) and (d), 41 and 37(c) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received about fifteen persons including the petitioner herein being involved in the trade of liquor, it is stated that a raid was conducted wherein 100 litres of mahua liquor and 2000 litres of jawa mahua solution was recovered. Two accused persons namely Sanjay Rajbanshi and Vivekanand Chourasia were arrested.

It is submitted by learned counsel for the petitioner that neither the petitioner was arrested at the spot nor any

Patna High Court CR. MISC. No.63590 of 2021(2) dt.18-04-2022 2/2 incriminating article has been recovered from his possession. The petitioner has been falsely implicated in the case because of his antecedents. He is in custody since 7.7.2021 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot and having remained in custody for more than 9 months, the Court directs the petitioner to be enlarged on bail in connection with Rajauli P.S. Case no. 222 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge II-cum-Special Judge, Nawada.
