2. The petitioner apprehends his arrest in connection with Mashrakh P.S. Case No. 449 of 2021 instituted under Sections 420, 120 (B), 467, 468, 471, 342, 504, 506, 406, 149 and 34 of the Indian Penal Code.
3. As per the prosecution case, co-accused Parshuram Mahto in the name of correction in the deed got transferred the land in question in his favour fraudulently in connivance of the accused persons including the petitioner.
4. Learned counsel for the petitioner submits that petitioner is quite innocent and has falsely been implicated in this case. He further submits that there is no specific role attributed to the petitioner and there is omnibus allegation of
Patna High Court CR. MISC. No.57665 of 2023(2) dt.13-09-2023 2/2 hatching conspiracy against all accused persons named in the F.I.R. including the petitioner. He also submits that similarly situated co-accused person Parsuram Mahto has already been granted anticipatory bail by Coordinate Bench of this Court vide order dated 26.09.2023 in Criminal Misc. No. 29052 of 2022.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount to each to the satisfaction of the learned J.M. 1st Class, Chapra (Saran) in connection with Mashrakh P.S. Case No. 449 of 2021, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) ashutosh/- U T
