JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Noor Sarai P.S. Case No. 140 of 2016 for the offences punishable under sections 147, 148, 149, 341, 323, 307 and 504 of the I.P.C and section 27 of the Arms Act.

Allegedly, the petitioner and seven other accused persons named in the FIR surrounded the informant and started abusing him, the petitioner made an attempt by Fasuli at the informant which hit on his nose and further co-accused Gaurav Paswan shot fire at him on which he fell down and thereafter other

Patna High Court Cr.Misc. No.50473 of 2016 (2) dt.19-12-2016 2/2 accused persons also caused injury to the informant. Submission is of false implication and that the occurrence of scuffle took place due to the land dispute but the informant has lodged false case of firing against the petitioner and other co-accused, no injury has been caused by the sharp cutting weapon on the person of the informant and this false case has been lodged against the petitioner and others only with a view to give pressure to withdraw the case in respect to the land dispute. In the facts and circumstances as stated above, let the above named petitioner, in the event of his arrest or surrender within six weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Nalanda in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
