JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Paraiya P.S. Case No. 140 of 2015 for the offences punishable under sections 304 (B) and 34 of the I.P.C.

Minta Devi was married with Ranjan Kumar @ Raja Ravidas @ Galmuha eight months ago and due to non fulfillment of demand of Bed and Chair in dowry the petitioners and other accused named in the FIR strangulated her to death. Submission is of false implication and that petitioner

Patna High Court Cr.Misc. No.17214 of 2018 (2) dt.09-04-2018 2/2 nos. 1 to 3 are Devers, whereas, petitioner no.4 is married Nanad of the deceased having no concern with the family affairs of the deceased and her husband, the husband is in custody, his trial is going on and during trial the informant has been examined as P.W.2 but he has not supported the prosecution case and has turned hostile, vide Annexure-2.

The learned A.P.P. submits that now the informant is retracting from his earlier version.

In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Santosh Kumar Dubey, J.M 1st Class, Gaya in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
