The petitioner seeks bail in anticipation of his arrest in connection with Bahera P.S. Case No. 51 of 2020 dated 10.02.2020 instituted for the offences under Sections 341, 323, 307 and 509/34 of the Indian Penal Code.

The accusation against the petitioner is of having assaulted the Informant by means of an iron rod on her head. The learned counsel for the petitioner has drawn attention of this Court to the injury report of the Informant which is part of the case diary which indicates that the Informant has received only simply injuries on her person. The sister-in-law of the petitioner has also lodged a case against the Informant and others on the charge of she and

Patna High Court CR. MISC. No.9991 of 2021(3) dt.29-03-2022 2/2 others having been assaulted for the allegation of the sister-inlaw of the petitioner practicing sorcery in the village. It appears from the subject F.I.R. and the F.I.R. of the counter case that some occurrence might have taken place because of the interse dispute in which some of the persons from both sides have received injuries.

Regard being had to the background facts and the nature of injury on the Informant being simple in nature, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateI, Benipur, Darbhanga in connection with Bahera P.S. Case No. 51 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
