The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 353, 224. 225, 332, 333 and 504 of the Indian Penal Code. As per the prosecution case, on receiving secret information when the informant and his team went to conduct a raid and caught hold a Maruti Suzuki 800 vehicle it is stated that the accused persons started to disturb the informant and others while carrying out their duty. The informant and others were attacked with lathi, danda, iron rod etc. as a result of which they also sustained injuries. The accused persons escaped. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. From perusal of the FIR itself the allegation against the petitioner is

Patna High Court CR. MISC. No.63755 of 2021(2) dt.18-04-2022 2/2 general and omnibus in nature. He is in custody since 30.7.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

It is further stated by learned counsel for the petitioner that a typographical error has occurred in paragraph no.3 of the petition and the correct position being that the petitioner has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent and having remained in custody for over 8 months, the Court directs the petitioner to be enlarged on bail in connection with Ganga Bridge P.S. Case no. 165 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
