JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report but according to the prosecution case itself, he was not caught on the spot and at the time of alleged occurrence, he was in jail custody. However, apprehended co-accused disclosed that at the direction of the petitioner and one other co-accused, they had come to commit the present occurrence.

Submission on behalf of the petitioner is that those coaccused, who were caught on the spot have already been granted privilege of bail.

No doubt, petitioner carries criminal antecedent of several case but considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.40697 of 2016 (2) dt.04-10-2016 2/2 as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S.Case No. 168 of 2015.
