JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341 and 354 of the Indian Penal Code and section 3(1)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the daughter of the informant Shukani Kumari and other girls of the village went to the orchard of Jag Narayan Yadav where the petitioner caught Shukani with intention to outrage her modesty. On alarm being raised by the daughter of the informant, the petitioner escaped from the scene.

It is submitted by the learned counsel for the petitioner that for a petty dispute the accusation has been levelled and even

Patna High Court Cr.Misc. No.42936 of 2015 (2) dt.16-10-2015 2/2 assuming the accusation, no case under section 354 IPC is made out. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Baheri P.S. Case No.235 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
