2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 34 of the Indian Penal Code.
3. The prosecution case in short is that, the petitioner's company took loan from the complainant's firm and assured to pay the complainant on time. On the assurance of co-accused Ajay Singh and Kailash Chandra Lohia, the complainant materials worth of Rs.45,16,500/- and as the materials was
Patna High Court CR. MISC. No.57066 of 2023(4) dt.21-12-2023 2/3 supplied, the complainant kept asking for the money. It is alleged that Rs.40 Lakhs has been transferred to the complainant's firm but Rs.5,16,000/- is still pending.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case on account of money dispute. No such occurrence, in the manner as alleged, has ever taken place. She submits that the petitioner is not the owner of the company in question rather he is working there as a Project Manager. There is no specific overt act against the petitioner. Petitioner has one criminal antecedent.
5. Learned APP for the State as well as learned counsel for the complainant opposed the prayer for anticipatory bail. It is submitted by the learned counsel for the complainant that the payment of Rs.5,16,000/- is still pending from the petitioner's end.
6. Having regard to the facts and circumstances of the case as well as considering that this a case of money dispute/business transaction between the parties, let the above named petitioner, be released on bail, in the event of his/her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.
