The petitioner seeks anticipatory bail in a case instituted for the offence under Section 302/34 of the Indian Penal Code.

It has been submitted that the petitioner is mother-inlaw of the deceased. There is no allegation of overt act against this petitioner. As per written report, the deceased was married with Anju Devi, who was daughter of this petitioner. There is allegation that Anju Devi had some relation with one Mithilesh Yadav for which the deceased always raised objection and thereafter Anju Devi had gone to her Maike with her brother Sunil Yadav. In the meantime, the father-in-law of the deceased called

Patna High Court Cr.Misc. No.375 of 2017 (4) dt.09-02-2017 2/2 him in Punjab for bidagiri of the girl. The victim got information that her son has died in his sasural.

As such, from the written report itself, it appears that there is no any allegation of overt act against this petitioner, who is said to be mother-in-law of the deceased.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Amour P.S. Case No. 83 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Purnea subject to the conditions as laid down under Section 438 (2) Cr.P.C.
