The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 372, 366/34 of the Indian Penal Code.

The prosecution case is that Muktar @ Mukhtar @ Md. Mukhtar entered into the house of the informant, ravished her and thereafter promise to marry with her. It is alleged that petitioner and co-accused Ansar Alam took the informant to Lucknow, where Muktar @ Mukhtar @ Md. Mukhtar again ravished her. The accused planned to push her to flesh trade but she managed to escape from the custody.

It is submitted by the learned counsel for the petitioner that complaint was filed after two and half months after the initial occurrence. The thrust of accusation is against

Patna High Court Cr.Misc. No.42853 of 2015 (2) dt.14-10-2015 Muktar @ Mukhtar @ Md. Mukhtar. Muktar @ Mukhtar @ Md. Mukhtar has been granted regular bail vide Cr. Misc. No. 33490 of 2015 on submission of the parties that the informant has married with the Muktar @ Mukhtar @ Md. Mukhtar. Though the petitioner is accused in one other case filed from the informant's side, in which he is on bail. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 55 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
