189 bottles of foreign liquor, while being loaded in a car adjacent to Indo-Nepal boarder, were seized and during course thereof, it has been alleged that petitioner was apprehended while others, namely, Ravi Kumar and Chandan Kumar (co-accused) managed to escape.

Petitioner happens to be under custody since 31.08.2016 having no criminal antecedent as is evident from para-3 of the petition.

Moreover, learned counsel for the petitioner also disputed over age of the petitioner which has been shown as 19 years in the written report.

Accordingly, petitioner, Avinash Kumar is directed to

Patna High Court Cr.Misc. No.47386 of 2016 (2) dt.08-11-2016 be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bairgania PS Case No. 154/2016.
