JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Balia P.S. Case No. 139 of 2021, registered for the offence punishable under Sections 392 and later on added Section 411 of the Indian Penal Code.

The petitioner is in custody since 26.05.2021. It has been stated in paragraph 3 of the application that the petitioner has no criminal antecedent. The First Information Report has been registered against unknown with the allegation that two miscreants snatched the informant's purse containing a mobile phone, some cash and certain documents. During the course of investigation, the petitioner's name surfaced as one of the persons, who had committed the offence.

Patna High Court CR. MISC. No.63388 of 2021(2) dt.07-04-2022 2/2 Learned counsel appearing on behalf of the petitioner has submitted that allegedly the snatched mobile phone has been recovered from co-accused Rupesh Paswan and not this petitioner.

Considering the circumstances that the petitioner is in custody since 26.06.2021, he has no criminal antecedent and the recovery of the looted article is from a co-accused, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in Balia P.S. Case No. 139 of 2021. (Chakradhari Sharan Singh, J) Pawan/- U T
