====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 04-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Kharik P.S. Case No. 144 of 2023, lodged on 18.06.2023, under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution, the FIR has been lodged against three unknown accused persons against whom there is an allegation that they have tried to make indiscriminate firing to terrorise the people of the vicinity.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the petitioner is not named in the FIR, his name has been figured in this case only on the basis of material that he

Counsel submits that antecedent of the petitioner is clean and he is in custody since 10.06.2024. Counsel also submits that other similarly situated co-accused has been granted bail by this Court vide order dated 24.04.2024 passed in Cr. Misc. 13584 of 2024.

4. Learned A.P.P. for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Naugachia, in connection with Kharik P.S. Case No. 144 of 2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
