JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Birpur P.S. Case No. 189 of 2016 registered under Sections 341, 323, 307, 427, 379 and 325/34 of the Indian Penal Code. The accusation is that petitioner along with his father Gobind Prasad Sah and mother Asha Devi, came armed with Khanti and hammer at the shop of the informant and caused injury at his head and shoulder. When Rupesh Kumar and Rajiv Ranjan, both brother of the informant, rushed to save him then they were also assaulted. At that time, they also snatched gold chain from his brother, Rupesh Kumar.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.45902 of 2016 (2) dt.13-12-2016 petitioner and the informant are agnates and due to some dispute occurrence took place, in which, petitioner also sustained injury, regarding which, Birpur P.S. Case No. 190 of 2016 is also instituted against the informant of the present case and his other family members. It is further submitted that petitioner has no criminal antecedent.
Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Birpur, Supaul, in connection with Birpur P.S. Case No. 189 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
