21-09-2016 Heard Smt. Usha Kumari Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The present petition has been filed with a prayer to restore Cr. Misc. No. 25184 of 2013, which stood dismissed on 21-07-2016 alongwith Cr. Misc. No. 26950 of 2013, due to nonprosecution. Learned counsel for the petitioner submits that so far as Cr. Misc. No. 26950 of 2013 is concerned, same has already been restored, vide order dated 24-08-2016 passed in Cr. Misc. No. 36020 of 2016.

It was submitted by learned counsel for the petitioner that since the arguing counsel Sri Jitendra Kumar Roy has become law officer, due to inadvertence, none appeared on the date when the case was called out.
