The petitioner apprehends his arrest in Daraunda (M.H. Nagar) P.S. Case No. 100/2016, registered for the offences punishable under Section 7 of the Essential Commodities Act. The Block Supply Officer, Hasanpura alleged that he raided the premises of the petitioner which was rented to Pradeep Kumar and from there huge quantity of wheat and rice bearing tag of FCI were recovered.

Learned counsel for the petitioner submits that the petitioner himself admitted that he has rented out the godown to Pradeep Kumar for business. The petitioner has no manner of concern with the business of Pradeep Kumar. Even though, during course of the investigation the witnesses have also stated the same

Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Daraunda (M.H. Nagar) P.S. Case No. 100/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
